NuvaRing Manufacturers and Distributors Sued for Wrongful Death in New Jersey
More than 50 lawsuits have been filed against the entities associated with the birth control product NuvaRing in the United States, but news was recently released that the latest lawsuit filed was not for injuries suffered as a result of the side effects that have been allegedly linked to the product. The latest lawsuit was for a claim of wrongful death, filed in Essex County, New Jersey.
NuvaRing is a birth control product that releases two synthetic hormones, etonogestrel (a progestin) and ethinyl estradiol (an estrogen), into the woman’s body. These substances are supposed to prevent ovulation as well as minimize any sperm penetration, thereby preventing unwanted pregnancies. This specific product is placed near the cervix, and it originally gained FDA approval in October of 2001.
However, the wrongful death complaint alleges that the parties named as defendants, which includes Organon USA, Inc., Organon Pharmaceuticals USA, Inc., Organon International, Inc., Akzo Nobel NV, Organon Biosciences, N.V., and Schering-Plough Corporation, not only knew about the potential side effects associated with NuvaRing, but concealed those risks from the public, including the FDA during the approval process.
These side effects allegedly linked to NuvaRing include the potential for blood clots to form due to the extremely high amounts of hormones that are released into the woman’s system. Blood clots can lead to breakdowns of tissue and organs, and can ultimately lead to the need for amputation and even death, which was apparently the case with Kelly Bozicev, a 32-year-old woman who began to use the product in May of 2007.
In December of 2007, the victim suffered a seizure and died on the way to the hospital, and the cause of death was determined to be massive pulmonary thromboemboli due to deep vein thrombosis in the pelvic veins. Mrs. Bozicev is survived by her husband and two young children.

The past couple of years have seen tremendous innovation in regards to birth control products that allow a female to follow a less-stringent routine to prevent unwanted pregnancies, but unfortunately, more than one of these products has also come under fire for their links to potentially serious side effects. The latest product to come under scrutiny is the NuvaRing birth control product, manufactured and distributed by Organon USA.
The product has not yet been made subject to a recall by the FDA, but more than three dozen lawsuits have been filed in the United States against the company, claiming serious side effects associated with the product have caused substantial injury and even death in some cases. NuvaRing is a hormonal contraceptive that works in a similar manner to another birth control product that’s been the subject of much controversy, the Ortho Evra birth control patch. However, its application is different from ‘the patch,’ as the NuvaRing is inserted into the vagina and worn for three weeks at a time and not worn during the fourth week.
Like the Ortho Evra birth control patch, the NuvaRing releases estrogen and progestin into the woman’s system, and these hormones help prevent unwanted pregnancies. If the NuvaRing is used properly, it has proven to be 99% effective in performing its intended duties. The advantage of the NuvaRing, much like the Ortho Evra patch, is that the woman does not need to follow a strict, daily regimen of taking a pill in order to prevent pregnancies. She only needs to remember to change the NuvaRing once per week and then not use it during the fourth week.
The problem that’s apparently arisen and that has led to these lawsuits is that users of the NuvaRing have reported serious side effects, including blood clot complications, most likely due to the high levels of estrogen and progestin that enter the system when the product is inserted. These blood clots can be extremely dangerous, and in the cases that have already been filed, the clotting problems have led to pulmonary embolisms, which are clots of the pulmonary artery, amputations and even death in extreme cases.

| Here is our story: For the past four years our daughter who is now 25 has been suffering tremendously as a result of being on the Nuvaring. About four years ago she began feeling EXTREMELY FATIGUED and felt sleepy ALL the time. Since she had been diagnosed with bipolar disorder the previous year, we believed that she was in the depressed phase of the illness. We took her to her psychiatrist who began prescribing antidepressants and stimulants to improve her mood and energy. This strategy was ineffective and she had to drop out of school and move back home. All she did was sleep and complain of a backache which we believed was caused by being in bed so many hours a day. We kept taking her to different psychiatrists who kept changing her medications without much change. Then we decided to take her to a sleep clinic where she did a sleep study. The doctor there diagnosed her with narcolepsy and said she would have to be on stimulants the rest of her life and take frequent naps to lead a normal life. Then we took her to a Chronic Fatigue clinic who told us she had all the classic symptoms of chronic fatigue. At this time, she was beginning to have horrible night sweats where her sheets would be soaking wet when she woke up. She would also feel hot and sweaty during the day and was keeping her air conditioning set below 70 degrees. Her back was getting worse and she was laying around with ice packs on her back for up to 6 hours a day. She was beginning to lose her hair. She was having sudden loss of coordination and actually fell down in her parking lot twice. She was having angry outbursts with her boyfriend. All of us were getting scared that this was something very serious, but all her blood work was coming back slightly off but still in the normal range. We sent her to the Mayo Clinic where she spent this past summer going through all kind of medical and lab tests. All the tests were coming back fairly normal and they told her they believed her symptoms were in her head and that she should seek counseling. We were beginning to lose hope but decided to keep searching on the internet for a link to her symptoms. We found a discussion group and found posting after posting of women who were living with all of these symptoms as a result of being on the Nuvaring. We took her off the Nuvaring on September 1, 2007 and slowly but surely her symptoms began to disappear. The night sweats slowed down and finally stopped. Her energy began to start coming back. Her backache subsided. It took 3 weeks before we began to see any difference. She is still going through tests at the Mayo Clinic...they have found some big tumors on her liver. She is going to see a transplant surgeon tomorrow to see if she needs to have surgery. Our daughter suffered needlessly for 4 years because no doctor thought the Nuvaring could be causing such life altering symptoms. We are looking for a lawyer to take our case. Karen Pippin | |

| I used the nuvaring for about three months and the second month i was using it i started to notice a lot of pain during intercourse. my fiance and i have only been with eachother, there was not change in anything we were doing but i was and currently still am having excruciating pain during intercourse. its sort of a burning pain. my gyno has treated me for a yeast infection thinking that may be the cause, it was not and i am now going to start using a steroid cream twice a day for 2 weeks. im being told now that if this doesnt work i will be sent to a vaginal specialist in philadelphia. im so upset. im getting married next year and i have been with my fiance for 5 years. all i wanted to do was try an easier birth control method. i am currently using yaz which is great but im still suffering the effects of the nuvaring. if anyone else is having a similar problem please let me know. i would like to speak to a lawyer but more importantly just get better! thanks! | |

| I was on Nuva ring for 3 years. Just a few weeks ago I went to the ER with severe chest pains. They did a CT scan and found blood clots in BOTH lungs. If they would\'ve have went to my brain I would\'ve had a stroke. I\'m only 28 years old, who\'d ever thought you\'d have pulmonary embolism at that age??? I may have to be on blood thinners the rest of my life. | |

| I have been on nuvaring for about a year, I am 24 years old and have been diagnosed with blood clots in both of my lungs, I advise you if you are on it to stop go get checked. I have to inject my self with blood thinners twice a day and take a oral blood thinner. I am 24 and this is not suppose to happen to some one so young, not to mention I am a single mother of two. I was in the hospital for a week and placed on bed rest for another week I am still in and out of the hospital and trying to raise my kids to. This should never of happened... | |

| I was on the nuvaring for only three months. On Nov. 3, 2007 I went to the emergency room because I was having severe chest pains and it felt like pins and needles every time that I took a breathe. They did x-rays and ct scans, and found out that I had two small blood clots in my right lung and a large blood clot in my left lung. They said that if I would have waited any longer that I would have died. They said that I had a pulmonary embolism. I was hospitalized for four days. They told me that once you have had a blot clot you will always have a risk to get another. I am only 25 years old. I am now taking the medication called Coumadin. They told me that I would be on this medication for six months to a year. They also told me that I can never be on any form of birth control for the rest of my life. | |
