After nearly 33 years on the market, DuPont decided that it would stop production of the chemical Benlate. Benlate had been linked with several adverse health side effects, however it was the legal suits that they cited as the main reason for recalling the product. Benlate was used quite successfully in destroying fungus. However, DuPont decided that the financial risk to their company was to great so on April 19th 2001, DuPont permanently stopped the production of Benlate.
The problems began for Benlate in 1989. The product was temporarily recalled amid allegations that when combined with certain herbicides Benlate could produce disastrous effects. In 1991, things only got worse. US farmers filed hundreds of class action lawsuits against DuPont claiming that Benlate had destroyed millions of dollars in crops. The majority of the cases were settled at a total cost of $750 million, one of the largest amounts paid out at the time.
The trouble for Benlate didn't end there. A couple were awarded $4 million , claiming Benlate caused their newborn child to be born without eyes. In 2000, DuPont were ordered to pay an additional $100 million in damages to two Texas fruit companies who alleged Benlate damaged their orchards. Additional lawsuits have been brought forward costing DuPont $1 billion. It is estimated that when all future suits have been decided the total legal cost to the company will be $1.3 billion.
